[gentoo-nfp] Trustee nominations

Since drobbins has (I believe) rescinded his offer, we
need to get going on getting some competent Trustees.

Now taking nominations....

Normally we'd take nominations for a month, and have the polls open for
a month, but I'd really like to compress that timeframe a bit.  Two
weeks and two weeks, perhaps?  Thoughts, comments?

Also, we're going to need three people who don't want to be a Trustee to
handle the election.  (I'd offer to be one of those people, but I doubt
that I would be viewed as an impartial participant.)

Um, by "competent Trustees", I meant ones other than what
we have now.  It's possible to read into the above a suggestion
that I was using "competent" in contrast with "drobbins", and
for that I apologize, since that's completely incorrect.  I
have no reason whatsoever to doubt drobbins' competence.

I don't wish to be a trustee, but I've actually been interested in
coming up with and applying methods for reaching a decision about
Daniel Robbins both here and in the forums for a while now. I've also
got a decent amount of time on my hands lately, and would like to see
this election happen honestly and efficiently. If I can be of help for
this, then just let me know.

I believe that you would be more than confident and qualified to continue to 
be a trustee.  If anything it took more competence to correct the problems 
with the foundation and I can't be the only one that believes so.  Yeah you 
made a mistake, was it your fault partially but it was partially the fault of 
the other trustees.  Grant you could have been one of the trustees to give up 
and walk away but you stuck it out and began to pick up the pieces and fix 
the problem.  And I would be glad to see you stay.

Infra would like these people, election officials, to be selected before
anything proceeds. So the election won't turn into a mess as others in
the past.

I don't think Grant was asking people to nominate anybody yet with
this thread. I'm pretty sure that Gentoo is just trying to find three
people to set up the election, and so far only I and one other person
that I see have volunteered. Perhaps if nominations are to go on, they
should be on a different thread? :)

I actually was asking for nominations as well as election officials,
although you're quite right that I should have used two different
threads.

Also, thank you for your generous offer to be an election official.
It's very much appreciated.  For technical reasons, though, the election
officials need to be developers.  (More specifically, the election
officials need to be people who have ssh accounts on dev.gentoo.org.
The voting takes place by foundation members leaving their ballots on
dev.gentoo.org in their home directories, having infra run a program as
root that collects all of the ballots, and then the election officials
each run the program that counts the ballots.)

Speaking of self-nominations, I'd like to propose that we make a rule
that people cannot self-nominate.  Personally, I find it a bit tacky.
Besides, if you can't get even one other person to nominate you, how
would you expect to actually win?  ;]

For council stuff sure. But foundation I think is a bit different. It's
less of an assumption to assume one might want to be on the council.
Than a trustee on the foundation. Given that most all are around for
technical reasons, not organizational. Much less legal and liable.

Plus with the past lack of nominees, or those even running. Can't see
why we would limit the pool. As stated, if they aren't known either way.
Not to likely to get voted for. So doesn't really hurt things to allow
them. No cost in adding another name to the ballot.

Not to mention would we want to encourage say, me going and asking
someone else to nominate me just to be formal. That's an easy way around
a technicality of no self-nominations. I considered that as well, but
was nominated before it was an issue. :)

I think either way things would work themselves. Possibly even for the
council. But it's not a huge deal, can live with either way.

While I agree it's tacky, I really don't think a rule should be imposed

And even more: reverse could be imposed here.

Knowing that work of trustee is not fun, requires lots of efforts, has
strict time schedule and work is hardly visible outside until something
became broken, people who are going to do this work should nominate
themselves. It's not easy to nominate - ask somebody to do this work.

Thanks for the nomination, but there's not a snowball's chance in Hell
that I'm going to put my name on any legal document involving Gentoo,
ever again.  I learned the hard way what it does to you and what the
community thinks of the Foundation and its trustees and I have no
intentions on ever subjecting myself to that level of harassment from a
bunch of people that are ignorant to the issues at hand.

Since no one else commented. I will. I think the timeline is fine, we
need to escalate things a bit. To resolve this sooner than later. I went
ahead and wrote up a PR piece and set some dates based on this timeline.
Others were concerned with picking random dates. I was just trying to
bring some formality to this process.

The dates I suggested based on the above timeline, and that the process
has some what begun is as follows

The official start date for nominations will be Sunday January 27th.
Nominations will end Saturday February 9th. The election polls will then
be opended on Sunday February 10th. With the polls closing on February
23rd.

Any objections?

Being as it's already January 27th:

Nominations start Jan 30th through Feb 12th,
Elections Feb 13th through 27th, new Trustees in march ;)

Grant, we are looking at you to hand reigns of elections over to the
officials, currently Rane and jmbsvicetto.  Fox2mike I believe is also
participating but is on vacation untli Feb 4.

Can we get an agreement on these days so we can get the nominations
going (officially)?

Yes, it wasn't expected days would go by with no response. So picking
any new dates is kinda pointless till we know when they will be
commented on.

No problem, unless we don't hear from Grant by the 30th. Then we reset
again and push back/delay some more.

fox2mike agreed to be on the infra side. If he is not, kingtaco has
offered to do it, but would prefer not.

Umm... how about "from now until the 12th" so we can just start and not
wait for Grant.

No offense, but this whole "we have to wait for $foo to comment" is why
we're very much in this boat in the first place.  Do any of you
seriously think that Grant is going to have some sort of objection to
the *dates* in which the election is held?

Also, votes can be called by the Foundation membership without Trustee
approval.

I'm a Foundation member.  I say we call this vote, starting nominations
now, ending the 12th, voting from the 13th through the 27th.  There, now
it's official.  Can we start nominating now?

Quit looking to the trustees for everything.  That is *also* how we got
into this mess.  We're perfectly capable of doing quite a lot without
the trustees, so long as we are acting on their behalf or acting on the
behalf of the Foundation.  As a Foundation member, one's vote counts
exactly the same as a trustee, except in cases where the board must make
a decision, which is generally only done as "proxy" to keep from having
to constantly poll the membership.  As opposed to the Council, which is
purely a "representative government" the trustees more directly answer
to the membership.  The members are the real voters.  The trustees just
work on their behalf to save time.  If the trustees do something the
membership doesn't like, the membership can vote and veto it and the
trustees cannot do a thing.  They don't have any real special powers,
other than what they're granted.  This is essentially the opposite of
the Council, which has *every* power except those that are explicitly
denied.

Anyway, at this point, we don't need to constantly wait on Grant except
in cases where a signature is required or access to our finances is
required.  Remember, it was designed this way on purpose to not impede
progress.

Thank you. I brought that up many times in IRC in #gentoo-dev. But got
no where :( So posted and waited. But voiced again today I wasn't happy
about it. I don't care what dates, just so we get moving ;)

Go ahead and write something up and we'll get it run through PR
tomorrow.  We'll want something on the announce lists, front page,
forums, etc. to point to the thread here.

One thing that I think most people forget is that anybody can nominate
someone.  You don't need to be a developer.  I do recommend that we
setup a page under the Foundation web space for the election *prior* to
the announcements being sent out just so we can link to it and people
can see it get updated as things happen.  I think that it'll give people
some confidence in the process if they can see it happening in front of
them.

We should also be explicit about what requirements there are for being
eligible to be a trustee, and possibly provide that list if it requires
someone having been a developer for some period of time.

Look,  I just want to have my ducks in a row.  The bylaws were not
ratified by anyone as far as I can tell; so it could be construed that
the foundation has only the trustees as members.  Now Grant mentioned:

"For practical purposes, we follow the proposed bylaws anyway, except where
there is clear precedence contradicting them."

Now to me that is not very clear; obviously we are nowhere close to
following certain items of the bylaws (they mention for example, that
we need a name and address for every member, which we don't have and
so on....)

There is no point in charging forward if the whole election ends up
being illegal and has to be redone.

That being said I'm happy to expedite things up to the limits of legal
necessity.

See we probably have three election officials now. Wouldn't it be best
to give them the time to investigate what needs to be done before the
election can start, and how much time they need to setup the
infrastructure. They need to get a list of (possible) foundation members
and make sure that every member can vote (current dev or not).

I would expect they know best and will give us the dates then.

Works for me.  Now I just have to compile a list of current members
who are no longer devs. 

The election officials need to check with infra to see if the
votify/countify scripts are still available somewhere.  Also, it would
be useful to know if the previous election data that used to be in
~agriffis/elections is still around somewhere.  (I'll check with Aron
myself, to see what he has.)

I'm positively surprised that I've been nominated as candidate. Big thanks to 
Steve, but you're crazy, man :)
What surprised me in the other direction was the rather inflammatory response 
from some people. It's not nice to attack like that when I'm not even 
subscribed to the list. On the upside it has made it easier for me to decide 
wether I should accept - if people feel that strongly about me they should 
have a chance to vote on it. So yes, I accept the nomination. 

A few words about me, maybe, to help you decide why you shouldn't vote for me?
I'm a 26-year-old research assistant slash PhD student at the University Berne 
in neutral Switzerland. I've been managing gentooexperimental.org for some 
time and as far as I can tell too many people depend on that. As Steve 
mentioned I also file lots 'o bugs and do silly things like Not the GWN. 
I guess at the moment my motto is "Be excellent to each other", I'm a follower 
of drobbins' philosophy of "It's supposed to be fun". If that includes lots 
of paper pushing so be it, as a mixed european I have already too much 
experience fighting silly bureaucracy. Can't be worse than resolving a 
three-country deadlock ...

There have been lots of good suggestions what the new trustees should or 
shouldn't do. I have some ideas about that too, but opinions are cheap. 
Getting a consensus and then getting things done is the tricky part. So I 
guess that's what I would focus on, but if anyone feels the need to extract a 
long-winded monologue from me just throw some questions at me, on-list or 
off-list and I'll do my best to play politician.

Seeing all the nominations I feel that there's at least one person still 
missing from the candidate list. Knowing him there's a good chance he'll 
decline, but maybe sending him a keg of beer or two will help. As one of the 
more active people in gentooland who interacts with users on a daily basis 
our bugwranglerman Jakub Moc seems to be a perfect candidate. 
He's reliable, well known for his low tolerance of stupidity and 
uncompromising - which has gotten him into fights with other devs a few 
times. Also there are rumors that Jakub has lots of legal experience (but 
I'll let him elaborate on that if he wishes). So instead of a legal checkmate 
you'll have a czech mate handling things. And if you ever need to discuss the 
finer points of beer he'll be your perfect discussion partner!

Executive summary:
I accept. Don't vote for me unless you have a good reason. I nominate Jakub.

everything that the Foundation does, except the bookkeeping and filing

I haven't fired up the paperwork for a legally codified role yet (needed
for a state employee in Germany) and have very strong doubts that the
approval process could be finished in time. So, no, sorry.

My employer requires that I receive permission before accepting a
position on the board of foundation. I asked for permission two years
ago and never received a reply.

That's sort of the crux of the issue though — I'm happy to do the bits
outside of the bookkeeping and taxes. My expectation is that Council
is going to take the lead on dissolving the Foundation this year and I
plan to contribute to that.

But I don't think I can (or want to) take on the other
responsibilities that we ultimately want an umbrella to handle for us.

As a result, I decline the nomination.
