* [gentoo-nfp] [RFC] Articles of Incorporation change: purpose of the foundation (doesn't mention Gentoo at all!)

Hey all,

one thing that I have always been wondering about - the purpose of the Gentoo
Foundation, as defined in the Articles of Incorporation [1] and referenced
e.g. in the bylaws, does not mention Gentoo at all!

Going by the given text, we could just donate all our money to the Perl
foundation and all would be good. Or not... This is actually a very strange
situation, and has been since the initial creation of the foundation.

****
So... I'd like to hereby kick off the discussion that the purpose of the
Gentoo Foundation should be specified better in its Articles of Incorporation.
****

Whatever conclusion we come to can then be filed as a change request to the NM
authorities.

Cheers, Andreas

Very embarrassing oversight. Good of you to notice it though and
bring it to attention.

I imagine it is because the people who wrote it didn't conceive of a
Gentoo separate from the Foundation. The Articles describe what
Gentoo does, though in an incredibly vague/general way (presumably to
allow latitude in its operations).

It wouldn't be a bad design but for the fact that many don't want to
have anything to do with the governance/operation of the Foundation,
for various reasons, which ends up creating a bit of a split
direction.

I'm not sure that adding some detail around Gentoo being a project
associated with a Linux distribution would actually fix the
fundamental issues, but I don't really see us ever moving away from
that.

I think stating Gentoo is the primary project we manage would not hurt
things, but I don't think it would help much either. As long as we are
able to manage other projects that's fine. A side effect of this is
that it would bring Gentoo (and presumably all projects within) under
direct control of the foundation. I'm not sure you'd want that (this
has been a point of contention in the past).

Before we amend the Articles of Incorporation we should discuss why
they are the way they are with Wayne Chew as he's the guy that set
up the foundation in the first place.
