Personally I'd expect the council to block the thing permanently. The council is, after all, supposed to serve as the last line of defence against people pushing through bad changes. Council members are supposed to be able to judge proposals based upon their merits, not the persistence of those trying to have them pushed through without following the proper process. There's no pawning the blame for this one off on arbitrary developers.
